Terms of Use

Optius (Optius.app and Optius app) is an online consumer service owned and operated by Heco et al ApS, CVR no. 41201207, Nordensvej 1, 7000 Fredericia.

The terms and conditions apply to Optius app and related services and platforms such as www.optius.app (hereinafter referred to as "Optius").

It is a condition for the use of Optius that these terms and conditions ("the agreement" or "conditions") are accepted.

Heco et al provides Optius to the user with the current content. Heco et al may change the content or functionality of these services without notifying the users.

For information on how Heco et al processes your personal data, please refer to Optius's privacy policy.

The terms apply to all services provided by the online service Optius.

Service

"Optius or the Optius app is a service that, with users' explicit consent, provides users with access to a range of features, as described below. The features available depend on the country in which the user has registered. Some countries will have access to more features, while others will only have access to selected features. Below are the available features."

Overview of their accounts: Users have the ability to connect their accounts in Optius to get an overview of their personal finances, including balance, income and expenses. However, this only applies to users in DK and those registered before 2024

Overview of their grocery expenses: The overview is created by collecting grocery receipts from different stores in one place. Users can choose which grocery stores they want to connect in the app. Each time a user wants to connect a grocery store to the service, the user will be asked to give consent for Optius to collect receipts from that store. Based on this, Optius provides users with ongoing access to a range of insights and the functionalities listed below, which are available on the "home" page.

The account function ("Accounts") allows the user to get an overview of the combined balance from all accounts, see all their accounts from different banks, and get an overview of income and expenses. However, this only applies to users in DK and those registered before 2024

The expense function ("Expenses") allows the user to get an overview of which categories they spend money on in selected grocery stores.

Under "Chemical Check," the user can see all purchased products that contain chemicals.

Under "Recalls," the user can see all food recalls from the Danish Veterinary and Food Administration and thus see if they have purchased recalled products.

As part of the grocery overview, there is a "eReceipts" page. This page collects all your original e-receipts and displays them in chronological order. In addition to various filters, Optius provides an overview of which stores the user has shopped at, for how much money, how often, and the average amount.

Profile creation

To use Optius, you need to create a profile. Creating a profile requires either 1) providing your email address and a password, or 2) creating an account via your Facebook account, or 3) via Apple ID. The profile you create is for your personal use.

To take full advantage of all features in Optius, you can provide additional information about yourself, such as postal code, age, gender, etc.

When creating a profile in Optius, you must enter a personal password, which should be treated confidentially.

Security

Optius always complies with the following minimum security requirements:

All data communicated between Optius and your device is encrypted. It is therefore not possible for external parties to access the content of the data stream between you and Optius.

Only authorized employees of Heco et al have access to production data for the purpose of ensuring data quality and troubleshooting, without further consent.

Heco et al regularly backs up all data in Optius.

Optius uses logging and records, among other things, from which IP addresses your profile is accessed. This is done through Cloud Functions for Firebase processes and temporarily stores the user's IP addresses. Firebase Authentication stores the user's IP addresses for up to a few weeks. Please read more under "Data processing information" here: https://firebase.google.com/support/privacy.

You are responsible for keeping your password confidential.

In case of misuse or suspicion of misuse of your password, you must immediately notify Heco et al by contacting the above address or contacting us through our online contact form. If Heco et al suspects misuse of your profile, we can always block your profile. Heco et al is not liable to you or any third party in these situations.

If you change your password or login information on Third-Party services, you will lose access to Optius until you update or inform us of the change.

Heco et al is in no way responsible for the user's compliance with Third Party terms.

Optius recommends that you, as a user, maintain a high level of security. You should:
- Ensure that your password is always sufficiently secure. This includes using special characters.
- Never give others access to your password.

Data collection from other digital services

With your explicit consent, Heco et al may collect information from Third Parties that store digital receipts for the purpose of your use of Optius. Only information that appears on your receipts is collected. See Optius's privacy policy for more information.

Heco et al may collect data from selected providers of digital receipts through Optius, but cannot guarantee that this is possible with all providers of digital receipts. The decision of which providers Heco et al collects data from is solely the decision of Heco et al.

With your explicit consent, Optius may collect information from your bank regarding your transactions for use in Optius. Only information about account name and transactions is collected. However, this only applies to users in DK and those registered before 2024

Optius can collect data from most banks, but cannot guarantee that this is possible with all banks. This only applies to users in DK and those registered before 2024

Communication between Optius and user

Optius may regularly inform you of important information, such as changes to these terms and conditions, via the email address you provide when creating your profile and/or via push notifications in the Optius app.

If you set goals in Optius under the goal function, you have the option to activate notifications. If your chosen goals are exceeded, you will receive a push notification.

Optius provides you with ongoing access to an overview of your expenses and related functions in the Optius app. The overview may include expense summaries, status regarding your expense goals, and similar information.

By creating your profile, you consent to Optius sending notifications about new features and other Optius-related materials to your email address and/or via push notifications in the app. Notifications can be disabled in your smartphone settings or under goals in the Optius app if goals are set.

Rights

All objects displayed on Optius, including but not limited to content, text, layout (e.g., graphics, logos, names, design, headings, button icons, scripts, and service names), and sound, are protected by intellectual property rights or property rights and belong to either Heco et al or a third party with whom Heco et al has entered into an agreement. You may not use the aforementioned for any purpose other than stated in this agreement.

Heco et al has all rights to its Services, including Optius app, and all other material on Optius. This includes, but is not limited to, copyrights, ownership rights, and trademark rights to Optius.

You retain the rights to the material you upload to Optius but grant Optius a non-exclusive right to use this material so that Heco et al can provide its Services to you and our Third Parties.

As a user, you are granted a non-exclusive right to use Optius. Heco et al may revoke this right at any time.

Operation, etc.

Heco et al seeks to avoid errors, defects, or operational disruptions on Optius, subject to the possibility of such occurrences. Heco et al appreciates being informed about such matters and will always strive to remedy them promptly, all contact is facilitated by completing our online contact form.

Heco et al performs ongoing maintenance and updates of the Optius app. In connection with maintenance, certain or all features may become temporarily unavailable. In connection with updates, one or more features may be removed from Optius.

Heco et al will, to the extent possible, provide information about expected operational disruptions in Optius in advance, and users will be informed about any removal of features, but Heco et al is not obligated to do so.

Heco et al is not responsible to its users in the event of errors, defects, operational disruptions, or removal of functionality.

Termination

If you disagree with the terms and conditions or for any other reason no longer wish to use Optius, you can delete your profile at any time. When you delete your profile, your data remains anonymized. We delete your password and username. Your receipt data will not be deleted but will no longer be associated with your user and will therefore be anonymous. Under "My profile" you can delete your user.

Heco et al can suspend or terminate your agreement to use Optius and potentially delete your user profile at any time and without notice, for example, in the case of unacceptable user behavior, attempts to misuse other accounts, attempts to access others' data, or other illegal or indecent behavior. If Heco et al suspends or terminates your agreement to use Optius, Heco et al will contact you via Optius or the email address you provided when creating your profile at Optius.

When your user profile is deleted, all data recorded on your user profile in Optius is permanently deleted or anonymized and cannot be restored. You cannot make any claims against Heco et al if your account is deleted.

Revocation of consent

You can revoke one or more of the consents you have given in Optius at any time. This could be regarding the collection of your receipt information or similar. Revocation can be done via our online contact form.

If you revoke one or more of your consents, you will still have access to your user profile in Optius app, but certain features may not be usable.

Liability

At no time can Heco et al be held liable for your use of Optius, including but not limited to actions or omissions based on information from Optius app. Your use of Optius and the use of the information you obtain through Optius are at your own risk and for your own responsibility. Heco et al is not responsible for the user achieving a specific result through the use of Optius and assumes no responsibility for services provided or operated by Third Parties.

Changes

Heco et al may revise or update this agreement by sending an amended version through the Service. If a change is significant, Heco et al will notify you of the change, either through the Service and/or through the contact information provided by you. Your continued use after such an update is considered an acceptance of the updated agreement. If you do not accept the update, you must stop using the Service.

Version

These terms were last updated in February 2024 and replace all previous applicable terms. The terms apply until new terms are issued.

Force Majeure

Heco et al cannot be held liable, directly or indirectly, in any way in the event of force majeure. Such force majeure events include, among other things, war, natural disasters, strikes, fires, and other conditions for which Heco et al is not responsible. In the event of a force majeure event, delivery under this agreement is suspended until the force majeure condition has passed. If the delay lasts for more than one month, both parties can terminate these terms without notice and without payment of compensation or damages to the other party.

Miscellaneous

The Service may contain links to third-party websites. Heco et al does not endorse any website or services by providing such a link. Therefore, Heco et al cannot be held liable in any way with respect to these third parties and their use of the information you provide them when visiting their website.

Heco et al can assign Heco et al's rights under this agreement, in whole or in part, to any person or entity at any time with or without your consent. You may not assign this agreement without Heco et al's prior written consent, and any unauthorized assignment by you will be invalid.

If a provision in this agreement is illegal, invalid, or unenforceable, the validity of that provision and the enforceability of the remaining agreement are not affected.

Disputes

If you find any content abusive or offensive, please immediately inform Heco et al by filling out our online contact form. The complaint must include: 1) a description of the content, 2) a description of where the content is located on the platform, and 3) your contact information.

Governing law and jurisdiction

If a dispute cannot be resolved through a complaint process, disputes shall be resolved by the City Court of Copenhagen. All disputes are subject to Danish law.

In the event of discrepancies in various language versions of the agreement, the Danish version shall prevail.
